The Board convened Monday, July 7, 2003 at 11:18 a.m. after the meetings of the various Board Committees. All Directors were present. The Chief Operating Officer and Executive Secretary were also present.
The Board reviewed the May 2003 minutes. Upon motion made by Dr. Davies and seconded by Ms. Scully, the minutes of the May 2003 meeting, copies of which were made available to all Directors, were adopted (unanimously). The Executive Secretary reported that there was an error in a reported vote in the April 2003 minutes. The vote on the allocation for a Parent Clubs Conference in 2004 was reported as unanimous, whereas Mr. Merriam actually voted against the motion.
The Chairman, Mr. Menaker, reported on the status of registration processing and indicated that the excessive backlogs have been eliminated.
The President, Mr. Cheauré, reported on staff and organizational changes and gave an update on changes to employee benefits.
The President reported on the status of the registration reengineering.
The Chief Operating Officer, Mr. Sprung, reported that the AKC Canine Health Foundation is now fully relocated to the first floor of AKC's Raleigh facility.
Mr. Sprung reported that Support Services are now reporting to Assistant Vice President, Barbara Schwartz.
Mr. Sprung reported on the reduction in force undertaken in July which will create efficiencies and also result in savings of over a million dollars a year beginning in 2004.
Mr. Stevens gave a financial update. The financial report for May showed total revenues of $5.3 million for the month and a net surplus of $343,000 after all expenses.
The individual registration figures for May 2003 are 108,874, versus 80,301 for May 2002.
The litter registration figures for May 2003 are 43,837, versus 39,501 for May 2002.
A revised 2003 budget was presented, which reflects a net deficit of $2.4 million for the year. This is the result of costs associated with the stabilization and redesign of the registration system.
The Board reviewed the make-up of the Trial Boards, which are periodically appointed per the Bylaws. The appointment of Trial Board members will be discussed further in August.
Mr. Crowley reported on a proposed amendment to ARTICLE XVIII, SECTION 1 of the Bylaws to provide for three meetings (March, June, and September), and one additional meeting, the time to be determined by the Board twelve months in advance. The amendment was proposed by the Beaumont Kennel Club and will be considered further in August.
Mr. Crowley reminded the Board that the Nominating Committee will be appointed at the August 2003 meeting.

- an examination of an endorsement registration system, rather than one using supplemental transfers.
- a rollback in supplemental transfer fees
- a space for voluntary microchip identification on the AKC registration form.
- an attractive registration certificate suitable for framing.
- actively encourage USDA APIS to complete its review and to strengthen enforcement of the Animal Welfare Act.

Following a motion by Mrs. Strand, seconded by Dr. Davies, it was VOTED (affirmative, Mr. Merriam, Mr. Goodman, Dr. Battaglia, Mrs. Strand, Dr. Davies, Dr. Garvin, Ms. Scully, Dr. Haines, Mr. Marden, Mr. Menaker, Mrs. Schaefer; opposed, Mr. Gladstone, Dr. Mays) to vote on the elimination of the program in August.
There was a motion by Mr. Merriam, seconded by Dr. Davies, and it was VOTED (affirmative, Mr. Merriam, Dr. Davies, Dr. Garvin, Mr. Marden, Mrs. Strand, Mr. Goodman, Mrs. Schaefer, Dr. Battaglia, Mr. Menaker; opposed, Mr. Gladstone, Dr. Mays, Dr. Haines, Ms. Scully) to consider the matter at this meeting, waiving the usual prior notice requirement.
Following a motion by Mrs. Strand, seconded by Mr. Goodman, it was VOTED (affirmative, Mr. Merriam, Mr. Goodman, Dr. Battaglia, Mrs. Strand, Dr. Davies, Dr. Garvin, Ms. Scully, Dr.Haines, Mr. Marden, Mr. Menaker, Mrs. Schaefer; opposed, Mr. Gladstone, Dr. Mays) to eliminate the Alternative Method of Judging Approval, effective immediately.
The Board considered a staff recommendation concerning the penalty imposed on Athena Lethcoe Harman and Jon Harman as a result of being found guilty of animal cruelty in a case involving 108 charges. They agreed to waive their right to appeal. They had also been charged under AKC disciplinary procedures for not being in compliance with AKC's identification requirements and for their failure to maintain their dogs and facilities in a manner acceptable to AKC. Because of the number of dogs involved and the horrific conditions these dogs were made to endure, the AKC Management Disciplinary Committee recommended that the Board impose a penalty outside of the guidelines and suspend Mr. and Mrs. Harman for life and to impose a fine of $1,000 on Athena and Jon Harman. It was VOTED to accept this recommendation.
There was a report on the actions taken by the AKC staff during the month of April 2003 on the cancellation of litters and individual registrations.
During the month of June, the registrations of 43 litters were cancelled: 6 because of impure breeding and 37 as a result of DNA Parentage Evaluation.
The cancellation of the 43 litters resulted in the cancellation of 44 registered dogs and rendered 137 dogs, members of these litters, ineligible for registration.
The following actions taken by the AKC Management Disciplinary Committee were reported:
Gary Brown (Beaverton, OR) was suspended by the Cascade Pointer Club for having a verbal altercation with another individual at its April 27, 2003 event. The AKC Management Disciplinary Committee imposed an event suspension of one month, effective April 27, 2003, and a $500 fine.
Joe Martin (Altamonte Springs, FL) was suspended by the Chinese Shar Pei Club of America for having a verbal altercation with another individual at its May 1, 2003 event. The AKC Management Disciplinary Committee imposed an event suspension of one month, effective May 1, 2003, and a $500 fine.
Wendy Miller (Ault, CO) was suspended by the Intermountain Kennel Club for using foul and abusive language at its May 2, 2003 event. The AKC Management Disciplinary Committee imposed an event suspension of one month, effective May 2, 2003, and a $500 fine.
Roy McFall (Anchorage, AK) was suspended by the Puget Sound Retriever Club for cheating at its April 6, 2003 event. The AKC Management Disciplinary Committee imposed an event suspension of three months, effective April 6, 2003, and a $500 fine.
Suzanne Bratt (Wellsville, OH) was suspended by the Mountaineer Kennel Club for conduct at their event on May 31, 2003. Ms. Bratt was charged with neglect of a dog in connection with an event. Specifically, Ms. Bratt failed to provide a safe environment for her dog at the show by leaving him unattended on a table at the event. The AKC Management Disciplinary Committee acted to suspend Ms. Bratt of all event privileges for a period of one month, effective May 31, 2003, and imposed a $100 fine.
Tim Slattery (Celina, TX) was suspended by the Pikes Peak Retriever Club for conduct at its event on May 31, 2003. Mr. Slattery was charged with misconduct of a dog in connection with an event. Specifically, Mr. Slattery booted and yanked his dog. The AKC Management Disciplinary Committee acted to issue a public reprimand and impose a $100 fine.

The AKC's Management Disciplinary Committee has suspended Virginia Kelley (Topping, VA) from all AKC privileges for a period of six months, effective July 7, 2003, and imposed a $500 fine for having submitted, or caused to be submitted, two litter registration applications which she knew, or should have known, contained false certifications. (Chihuahua)
Dr. Davies gave the Events and Clubs Committee Report on fines assessed clubs for late submission of date applications and judges panels.

Following a motion by Dr. Davies, seconded by Mrs. Schaefer, it was VOTED (unanimously) to approve the revised Toy Fox Terrier breed standard as published in the GAZETTE. The effective date is August 27, 2003.
The Board considered a proposal to amend Chapter 3, Section 22 of the Rules Applying to Dog Shows to modify the Miscellaneous Class. The proposal would encompass the following:
- Mandatory breed classes.
- A Puppy Class.
- A Best of Breed award.
- A Best in Miscellaneous competition.
- Remove the italics.
Following a motion by Dr. Garvin, seconded by Mr. Gladstone, it was VOTED (unanimously) to refer the matter to the Delegate Dog Show Rules and All-Breed Clubs Committees for input.
The Board considered a proposed amendment to Chapter 11, Section 6 of the Rules Applying to Dog Shows to reformat the section and provide for the transfer of dogs among the classes with age requirements and between color divisions of a class up to one hour prior to the scheduled start of judging for that breed or variety. Following a motion by Dr. Battaglia, seconded by Mrs. Strand, it was VOTED (unanimously) to recommend amending Chapter 11, Section 6 to read as follows:
Chapter 11, Section 6.
No entry may be changed or canceled, other than as provided for herein,
unless notice of the change or cancellation is received in writing, prior
to the closing date by the Superintendent or Show Secretary, named in
the premium list to receive entries. At least one half-hour prior to the
scheduled start of any regular judging at the show, the Superintendent
or Show Secretary may transfer a dog from one of the regular classes to
the Best of Breed or Variety competition for dogs which according to their
owners' records have completed the requirements for a championship after
the closing of entries for a show, but whose championships are unconfirmed.
At least one hour prior to the scheduled start of judging for the breed or variety involved, the Superintendent or Show Secretary may:
- Make corrections to either the dog's name or number, never both, provided all other information on the entry form is correct.
- Transfer a dog from one age division of the Puppy Class to another.
- Transfer a dog between the Puppy and Twelve-to-Eighteen Month Class.
- Where applicable, transfer a dog from one color division to another.
No dog may otherwise be transferred to another class. Owners are responsible for errors in the entry forms, regardless of who may make such errors.
This change will be read at the September 2003 Delegates meeting, for a vote in December.
The Board reviewed its policy governing the holding of specialty shows following an all-breed show on the same site. The issue was the possibility of a judge exceeding the maximum number of dogs that may be judged when the all-breed and specialty assignments are totaled.
The Board considered a recommendation from the American Dog Show Judges organization to modify AKC's policy on the use of ramps in judging to read "Any breed may be judged on a ramp at the discretion of the judge." Staff recommended no change to the existing policy for the following reasons:
- Parent Clubs and exhibitors in some breeds do not wish their breeds to be judged on ramps.
- It would put larger dogs in closer proximity to a judge's face. Poor temperament and unfamiliar footing could cause a problem.
- Ramps would have to be available for all rings in the event a judge requests one.
- Exhibitors in all breeds would have to train their dogs on ramps even though they may never be used.
- A ramp may restrict access to examine the dog from some directions.
- Exhibitors of non-ramp breeds may now request refunds if they are forced to use a ramp due to an emergency. They would lose that prerogative under the proposal.
Following a motion by Mr. Marden, seconded by Dr. Battaglia, it was VOTED (unanimously) to make no changes to the current policy of judging dogs on a ramp.
The committee also discussed the exhibition of spayed or neutered dogs in non-regular classes, points for reserve at some National Specialty shows, the listing of handlers in the catalog, and judging approval for retiring AKC employees.
The Board considered the eligibility criteria for entering the Open Stake for Lure Coursing events. Following a motion by Mrs. Strand, seconded by Ms. Scully, it was VOTED (affirmative, Mrs. Strand, Ms. Scully, Mr. Merriam, Mr. Menaker, Dr. Haines, Mrs. Schaefer, Mr. Goodman, Dr. Battaglia, Dr. Garvin, Dr. Mays, Dr. Davies, Mr. Marden; abstaining, Mr. Gladstone) to remove non-AKC titles from these criteria. Effective January 1, 2005, Chapter IX, Section 1 of the Regulations for Lure Coursing are amended to read as follows:
Chapter IX, Section 1 (Open Stake)
Open to all hounds of a breed that have obtained at least one of the following:
1. AKC Junior Courser title.
2. American Kennel Club Field Champions of Record of that breed may be
entered.
Hounds that are disqualified (or dismissed twice within six trials) from
Field Trials may not be entered.

The Board reconvened Tuesday, July 8, 2003, at 8:00 a.m. All Directors were present. The Chief Operating Officer and Executive Secretary were also present.
Mr. Merriam and Dr. Haines, members of the Appeals Committee, left the meeting.
The Board considered the revocation of judging privileges from Charles "Ron" Carr and John Chokran as a result of their judging of the Gordon Setter Club of America's April 27, 2003 Field Trial. They could not reach agreement on the placements for the Derby Stake and refused to sign the judge's book. As a result, the results of the stake were voided and all entrants received a refund. It was VOTED to suspend the judging privileges of Charles "Ron" Carr and John Chokran for a period of three years, effective July 7, 2003.
The Board considered the revocation of judging privileges from Bob Erbe for conduct unbecoming a judge. While handling a dog in a stake at the Ozark German Shorthaired Pointer Club's March 14, 2003 trial he used a tracking device to scout a dog in contention. It was VOTED to suspend the judging privileges of Bob Erbe for three years, effective July 7, 2003.
Mr. Merriam and Dr. Haines returned to the meeting.
The committee also discussed the eligibility requirements for English Springer Spaniel Field Trial judges.
The Board considered a proposal to permit some FSS breeds to compete in AKC Companion and Performance events. Following a motion by Ms. Scully, seconded by Mrs. Schaefer, it was VOTED (unanimously) to adopt the following, effective for events held after January 1, 2004:
1. Make all FSS recorded breeds that meet the following minimum requirements, eligible to compete in the AKC all-breed companion events, i.e., Agility, Obedience, and Tracking. Requests from the National breed clubs would then be considered on a case-by-case basis for the Performance Events governed by Regulations. (Earthdog, Lure Coursing, Herding, and Hunting Tests).
- A minimum of 150 recorded dogs per breed, with a 3-generation pedigree.
- A national breed club with members in at least 20 states.
- A breed standard.
2. Amend the second paragraph of Chapter 1, Section 12 of the Obedience Regulations to read as follows:
"Dogs approved for entry in the Miscellaneous Class at dog shows and dogs of Foundation Stock Service recorded breeds that meet the eligibility requirements for competition, are eligible to participate in Obedience trials and/or Tracking tests provided the dog's AKC identification number appears on the entry form."
3. Amend the fourth paragraph of Chapter 1, Section 3 of the Regulations for Agility Trials to read as follows:
"Dogs eligible for entry in the Miscellaneous Class at dog shows and dogs of Foundation Stock Service recorded breeds that meet the eligibility requirements for competition, are eligible to participate provided their AKC identification number appears on the entry form."
4. Requests for breeds to compete in the various Performance Events would be subject to Board approval and considered on a case-by-case basis.
The breeds affected by the above include:
The Irish Red and White Setter, the Cesky Terrier, the Norwegian Lundehund, The FSS Black and Tan Coonhound, the Bluetick Coonhound, Coton de Tuléar, American English Coonhound, Treeing Walker Coonhound, Peruvian Inca Orchid, Sloughi, Dogue De Bordeaux, Tibetan Mastiff, Perro de Presa Canario, Chinook, Norwegian Buhund, Swedish Vallhund, Finnish Lapphund, Pyrenean Shepherd.
Per Section 7 of the Junior Showmanship Regulations, FSS breeds are not eligible to enter in Junior Showmanship.
Mr. Merriam gave the report from the Business Committee.
The Business Committee considered an increase in the annual licensing fee for superintendents and a new annual fee for event secretaries, who do multiple events. The committee was to consider media coverage of AKC approved events.
Dr. Battaglia gave a report from the Operations and Planning Committee.
The Board considered a proposed amendment to ARTICLE VIII, SECTION 1 of the AKC Bylaws submitted by the Delegate Bylaws Committee to enable the Nominating Committee to nominate more than one candidate for each vacancy to be filled at the annual meeting. Following a motion by Dr. Battaglia, seconded by Ms. Scully, it was VOTED (unanimously) to disapprove the proposal. It was the Board's consensus that under the current provisions of the Bylaws, the Nominating Committee has the responsibility to select the most qualified candidates in its opinion. Any other aspirant then has the opportunity to run by petition and several have done so successfully. The Board believes that the charge of the committee should be to select the most qualified candidates and not to avoid having to disappoint some Delegates by just eliminating the obviously least qualified candidates.
The Board considered the insertion of an arbitration clause on AKC entry forms and registration certificates. The proposal was:
That the following clause be inserted in all official AKC entry forms and that the Superintendents and entry services be advised of the change so they can obtain updated entry forms.
"I (we) agree that any cause of action, controversy or claim arising out of or related to the entry, exhibition or attendance at the event between the AKC and/or this club and myself (ourselves) or as to the construction, interpretation and effect of this Agreement shall be settled by arbitration pursuant to the applicable rules of the American Arbitration Association. However, prior to arbitration all applicable AKC Bylaws, rules and procedures must first be followed as set forth in the AKC Charter and Bylaws, rules, published policies and guidelines."
The individual clubs may opt out of the procedure for themselves by deleting the phrase "or this club."
That the following clause be inserted in all AKC registration applications (litter, individual dog registration, transfer and certificate).
"I (we) agree that any cause of action, controversy or claim arising out of or related to this registration or as to the construction, interpretation and effect of this clause shall be settled by arbitration pursuant to the applicable rules of the American Arbitration Association. However, prior to arbitration all applicable AKC Bylaws, rules and procedures must first be followed as set forth in the AKC Charter and Bylaws, rules, published policies and guidelines."
Following a motion by Mr. Gladstone, seconded by Dr. Battaglia, it was VOTED (unanimously) to adopt the above provisions, effective January 1, 2004.
The committee also discussed mandatory DNA requirements, required microchips incentives for registrants, dialog with foreign registries on DNA, the advancing of DNA requirements, the Foundation Stock Service and DNA, and criteria for the granting of registered kennel names.
Mrs. Strand gave a report from the Public Relations and Public Affairs Committee.
The Board considered a number of proposed position statements. Following a motion by Mrs. Strand, seconded by Mr. Marden, it was VOTED (unanimously) to adopt the following position statement:
Guardian vs. Owner
The American Kennel Club supports the use of the term "owner"
rather than "guardian" when referring to the keeping of dogs.
The AKC believes that the term guardian may in fact reduce the legal status
and value of dogs as property and thereby restrict the rights of owners,
veterinarians and government agencies to protect and care for dogs. It
may also subject them to frivolous and expensive litigation.
The term guardian does nothing to promote more responsible treatment of dogs. We strongly support efforts to educate the public about responsible dog ownership to ensure that all dogs receive the care, love and attention they deserve.
Following a motion by Mr. Marden, seconded by Mrs. Strand, it was VOTED (unanimously) to adopt the following position statement:
Homeowners' Insurance and Dangerous Dogs
The American Kennel Club believes that insurance companies should determine
coverage of a dog-owning household based on the dog's deeds, not the dog's
breed. If a dog is a well-behaved member of the household and the community,
there is no reason to deny or cancel coverage. In fact, insurance companies
should consider a dog an asset, a natural alarm system whose bark may
deter intruders and prevent potential theft.
The Board reviewed its policy on Auctions, considering the recommendations of the High Volume Breeders Committee. Following a motion by Mrs. Strand, seconded by Mr. Gladstone, it was VOTED (unanimously) to revise AKC policy on auctions to read as follows:
1. "The American Kennel Club considers auctions and raffles not to be reasonable and appropriate methods to obtain or transfer dogs." (Note: items 1 and 2 have been reversed in order, but no wording has been altered).
2. "AKC's current inspection program shall include kennels/individuals offering dogs for sale at auctions."
3. "Any dog sold at auctions that is under 8 weeks of age or without microchip identification will be ineligible for AKC registration and shall be placed on permanent referral."
4. "The American Kennel Club discourages Parent Club rescue groups from purchasing dogs at auctions. Although Parent Clubs may be doing good things for individual dogs purchased at auctions, it perpetuates the problem and tends to create a seller's market. Reciprocally, auctioneers seek more dogs of those breeds to offer at auctions. AKC applauds the work of Parent Club rescue groups on many fronts. However, AKC believes that the purchasing of dogs at auctions is not overall in the best interest of purebred dogs."
The committee also considered recommendations from the High Volume Breeders Committee on the compliance staff, on legislation and regulatory initiatives, and AKC banners and signs at AKC events.
The Board wished to go on record as being very pleased with the Family Dog publication, and to extend its compliments to the staff involved with its production.
The Board considered a staff proposal for the development of an on-line litter registration capability, as follows:
A critical step in the creation of a more efficient and user-friendly registration system is an on-line registration capability. The first step in such a system is the on-line registration of litters.
Under the planned system, it would be possible for a pin code to substitute for an owner's signature. It becomes more complicated, however, when there are multiple co-owners. Effective November 1997, the Board adopted a policy requiring the signature of all dam owners to register a litter. This was done to prevent the situation where the litter was registered with only one of the co-owners of the dam signing, but with the other co-owners then refusing to sign the individual registration applications. Initially, the on-line litter system was designed to only accommodate dams with one owner because of the Board policy. However, this would preclude much of AKC's core sports constituency, who more often co-own dogs, from taking advantage of the on-line system.
For on-line applications only, it should be possible for one of the dam owners to submit the application, certifying that he or she has the authorization of any other co-owner(s). Should this be found not to be the case later, disciplinary action would be instituted for false certification. This same procedure could later be extended to on-line individual registrations.
Hard copy litter applications would still have to be signed by all dam owners. This would be an added incentive to register on-line.
The existing policy is that "All co-owners of the dam must sign the litter application form." It could be modified for on-line litter applications so that any one of the dam co-owners may submit the application with a certification that he or she has the written authorization of the other co-owner(s). Should a problem develop, the co-owner that submitted the application could be required to produce that authorization.
Following a motion by Dr. Battaglia, seconded by Mrs. Schaefer, it was VOTED (unanimously) to permit one co-owner of a dam to submit an on-line litter application with a certification that he or she has the written authorization of all other co-owners and would be able to produce such authorization if requested by AKC.
The Board discussed the Working Dog Sport. There was a motion by Mr. Marden, seconded by Dr. Battaglia, to approve the Working Dog Sport program. There was a motion by Mrs. Schaefer, seconded by Ms. Scully, and it was VOTED (affirmative, Mrs. Schaefer, Ms. Scully, Mrs. Strand, Dr. Garvin, Dr. Haines, Mr. Menaker, Mr. Gladstone, Dr. Mays; opposed, Dr. Battaglia, Mr. Merriam, Mr. Marden, Dr. Davies, Mr. Goodman) to postpone action of the Working Dog Sport until after the September 2003 Delegates meeting.

There was a motion by Dr. Battaglia, seconded by Dr. Haines and it was VOTED (affirmative, Dr. Davies, Dr. Haines, Mr. Menaker, Ms. Scully, Mrs. Strand, Mrs. Schaefer, Dr. Battaglia, Dr. Mays, Mr. Goodman, Mr. Marden; opposed, Mr. Gladstone, Dr. Garvin, Mr. Merriam) to consider modifying the policy at this meeting, waiving the usual prior notice requirement.
Following a motion by Dr. Haines, seconded by Dr. Davies, it was VOTED (affirmative, Dr. Haines, Dr. Davies, Mr. Gladstone, Dr. Battaglia, Mrs. Schaefer, Ms. Scully, Mrs. Strand, Mr. Goodman, Mr. Marden, Mr. Menaker, Dr. Garvin, Dr. Mays; abstaining, Mr. Merriam) to revise the wording to read:
"Any club, which is eligible to hold AKC events, may conduct Schutzhund-like or Working Sport activities only with the advance written permission of The American Kennel Club. Failure to comply with this policy may result in the revocation of a club's event-giving privileges.
Special Attractions consisting of demonstrations by uniformed police or military units where dogs are demonstrating the skills necessary for law enforcement and/or homeland defense may be conducted at AKC events with the advance written permission of The American Kennel Club."
Following a motion by Mr. Gladstone, seconded by Mr. Goodman, it was VOTED (affirmative, Mr. Gladstone, Mr. Goodman, Mr. Menaker, Mr. Marden, Dr. Davies, Mrs. Strand, Ms. Scully, Mrs. Schaefer, Dr. Mays, Dr. Battaglia, Mr. Merriam, Dr. Haines; abstaining, Dr. Garvin) to approve the German Shepherd Dog Club of America and the Doberman Pinscher Club of America to hold a Pilot Trial, utilizing the Working Sport rules AKC has developed. The Pilot Trials would be held in conjunction with the club's October 2003 National Specialty Shows. Should the Working Dog Sport be officially approved, dogs would receive credit towards AKC titles as a result of competition at these Pilot Trials.
Under New Business, Mrs. Strand put forward a proposal to again review the single tier registration concept for further consideration by the Board Operations and Planning Committee.
