AKC Board Minutes
November 2002

The Board convened Monday, November 11, 2002 at 11:24 a.m. after the meetings of the various Board Committees. All Directors were present as were the Chief Operating Officer and Executive Secretary.

The Board reviewed the October 2002 minutes. Dr. Garvin pointed out that Mr. Marden, rather than he, was on the Appeals Committee. Upon motion made by Mrs. Strand and seconded Mr. Goodman , the minutes of the October 2002 meeting, copies of which were made available to all Directors, were adopted as revised (unanimously).

The Chairman, Mr. Menaker, reported that final report of the DNA Advisory Committee had been received. He has expressed his appreciation to the committee members and that portions of the report will be reviewed by the appropriate Board Committees and in a Board workshop.

Mr. Menaker reported on DOGNY. A check for $811,083 was received from Hartz Mountain from the sale of the stuffed toy search and rescue dogs, all of which will go to the AKC CAR Support and Relief Fund. AKC had also arranged with THF Publications to produce a hard cover book on DOGNY. It will include photographs of all the dogs and a description of what was intended by each artist.

Mr. Menaker reported on a meeting held between members of the Board and a number of licensed superintendents. He indicated that the meeting was positive, with matters of mutual interest discussed.

The President, Mr. Cheauré, reported on planned improvements to the AKC web site. They included a decreased store presence on the home page, increased news presence and accessibility from the home page, and improved direct navigation to AKC Board minutes and official actions.

Mr. Cheauré gave an update on the development of a Business Continuity Plan.

Mr. Cheauré reported on the establishment of an Internal Management Consulting Team. Assignment to the Internal Consulting Group will provide exceptional/highly ranked employees an opportunity to learn new analytical and managerial skills and increase their knowledge of the AKC business. Fast-track college graduates from outside the AKC will also be recruited into this program.

The initial group will consist of four internal consultants. One dedicated team leader will be responsible for managing the group, their assignments, and their training and development. Consultants will serve for approximately 12 to 18 months. The initial group will be located in the North Carolina office, although projects will be for both offices.

Mr. Cheauré reported on Information Systems priorities for 2003.

Dr. Battaglia reported to the Board that he attended and spoke at the Transportation Security Agency (TSA) International Bomb Detection Conference. The conference focused on standards and certifications.

Mr. Gladstone reported that he had attended a reunion of New Jersey Search and Recovery teams that worked at the New York landfill following September 11.

Mr. Stevens gave a financial update. The Financial Report for October 2002 showed an excess of operating expenses over revenue of $446,000.

The individual registration figures for October 2002 are 77,749, versus 81,793 for October 2001.

The litter registration figures for October 2002 are 35,753 versus 36,618 for October 2001.

There was a discussion of the 2003 budget presented by management. Mr. Stevens was present for this discussion. Following a motion by Mr. Marden, seconded by Mr. Kelly, the 2003 budget was adopted.

Mr. Marden gave the report for the Pension Committee, which met earlier in the day. The committee had amended the AKC Pension Plan in accordance with new IRS rules on mortality rates, effective January 1, 2003. The committee reduced the expected annual rate of return on plan assets from 9% to 8%. The committee also reviewed the performance of the pension plan over the past several years.

Mr. Hayes, staff, was present for discussion of items pertaining to judging.

The Board considered a request for the reinstatement of judging privileges from Mr. Fred Lanting. Mr. Lanting's judging privileges were suspended in November 2000 for his trading and trafficking in dogs. It was VOTED to not consider the reinstatement of Mr. Lanting's judging privileges before November 2005.

There was a discussion on the granting of adjunct breeds to all, rather than just some, Board members. Under existing policy, when a new breed is admitted to a group, judges approved for all breeds in that group, including Board members, receive automatic approval to judge the breed. Other judges, but not Board members, may apply for the breed on an adjunct basis. Based upon a staff recommendation, and following a motion by Mr. Gladstone, seconded by Mr. Goodman, it was VOTED (affirmative, Mr. Gladstone, Mr. Goodman, Mr. Merriam, Mrs. Strand, Mr. Menaker, Dr. Mays, Dr. Battaglia,, Dr. Garvin, Ms. Scully, Mr. Kelly, Mr. Marden, Dr. Davies; opposed, Mrs. Schaefer) to permit Board members who are approved for five or more breeds to receive new breeds on an adjunct basis after paying the applicable application fee and passing the breed standard test or to apply under the adjunct breed process.

Dr. Davies, Mr. Gladstone and Mr. Marden, members of the Appeals Committee, left the meeting prior to the report on Judges Applications.

Following completion of the report on Judges Applications, Dr. Davies, Mr. Gladstone and Mr. Marden returned to the meeting.

Mr. Slay, staff, participated in the portion of the meeting dealing with disciplinary actions.

The Board reviewed the Report and Findings of the South Central Trial Board, which considered an appeal from Deborah Martin (Vancleave, MS). Ms. Martin was suspended by the Bayou Kennel Club for disregard of published club regulations at its August 31, 2002 show. The AKC Management Disciplinary Committee imposed a suspension from show privileges only of three months, effective August 31, 2002, and a fine of $1,000. The Trial had granted the appeal, setting aside the suspension and fine.

There was a report on the actions taken by the AKC staff during the month of October 2002 on the cancellation of litters and individual registrations.

During the month of October, the registrations of 51 litters were cancelled: 17 because of DNA Parentage Evaluation, 33 because of impure breeding, and 1 at the request of the litter owner(s).

The cancellation of the 51 litters resulted in the cancellation of 85 registered dogs and rendered 215 dogs, members of these litters, ineligible for registration.

The following actions taken by the AKC Management Disciplinary Committee were reported:

Shawn Blanchard (Russell, MA) was suspended by the Mid Hudson Beagle Club for conduct at its event on August 19, 2002. Specifically, Ms. Blanchard was charged with verbal abuse of a judge. The AKC Management Disciplinary Committee acted to suspend Ms. Blanchard from all event privileges for six months, effective September 19, 2002, and imposed a $500 fine.

Gary Melrose (Claremore, OK) was suspended by the Tula Retriever Club for conduct at their event on September 29, 2002. Specifically, Mr. Melrose was charged with having a physical altercation. The committee acted to suspend Mr. Melrose from all event privileges for two months, effective October 3, 2002, and a $200 fine was imposed.

Patricia Edgington (Bradenton, FL) was suspended by the Pilgrim Doberman Pinscher Club for conduct at its event on October 5, 2002. Specifically, Ms. Edgington was charged with impairing a club's ability to retain a site. The AKC Management Disciplinary Committee acted to suspend Ms. Edgington from all event privileges for a period of three months, effective October 5, 2002, and imposed a $500 fine.

Thomas Wright (White House, TN) was suspended by the Basenji Club of America for conduct at its event on October 4, 2002. Specifically, Mr. Wright was charged with inappropriate treatment of a dog. The AKC Management Disciplinary Committee acted to issue a public reprimand and a $100 fine was imposed.

Dorothy Holmes (Scottsdale, AZ) was suspended by the Valencia Valley Kennel Club of New Mexico for conduct at its event on October 12, 2002. Specifically, Ms. Holmes was charged with abusive and foul language. The AKC Management Disciplinary Committee acted to suspend Ms. Holmes from all event privileges for two months, effective October 12, 2002, and a $500 fine was imposed.

Corky Vroom (El Monte, CA) was suspended by the Del Valle Dog Club of Livermore for conduct at their event on October 21, 2002. Specifically, Mr. Vroom was charged with verbal abuse of a judge and disruptive public criticism of a judge's decision. The AKC Management Disciplinary Committee acted to suspend Mr. Vroom from all event privileges for disruptive public criticism of a judge's decision for three months, effective October 21, 2002, and imposed a $300 fine.

The Board considered a request for reinstatement submitted by Charles (Corky) Vroom. Mr. Vroom was suspended by the Event Committee of the Del Valle Dog Club of Livermore for verbal abuse of a judge and for disruptive criticism of a judge's decision at its October 21, 2002 show. The AKC Management Disciplinary Committee found that the first charge did not apply, based upon the evidence, but it did sustain the latter, imposing a three-month suspension, effective October 21, 2002, and a $300 fine. Mr. Vroom applied to the Board for reinstatement. It was VOTED to reinstate Mr. Vroom, effective November 21, 2002, and to impose a $500 fine.

After some discussion, staff was directed to clarify the difference between verbal abuse against a judge, disorderly conduct, and disruptive criticism of a judge's decision. The categories all appear in the Discipline Guidelines and it could be unclear when each would apply.

The AKC's Management Disciplinary Committee has suspended the following individuals from all AKC privileges for a period of ten years, effective November 11, 2002, and imposed fines of $2000 each for failure to comply with the recordkeeping and identification requirements of Chapter 4 of the Rules Applying to Registration and Discipline. Further, reinstatement will be contingent upon their beginning with a new colony:

The AKC's Management Disciplinary Committee has suspended Steve Britton (Montrose, MI) from all AKC event privileges for a period of one (1) year, effective November 11, 2002, and imposed a $1000 fine for having entered, or caused to be entered, a dog which he knew, or should have known, had been altered. The AKC's Management Disciplinary Committee has suspended Tim Green (Licking, MO) from all AKC privileges for a period of two (2) years, effective November 11, 2002, and imposed a $2000 fine for refusal to make his dogs and records available for inspection when requested and failure to maintain his dogs and facilities in a manner acceptable to The American Kennel Club. The AKC's Management Disciplinary Committee has suspended Michele Rush (Vance, MS) from all AKC privileges for a period of one (1) year, effective November 11, 2002, and imposed a $1000 fine for failure to maintain her dogs and facilities in a manner acceptable to The American Kennel Club. The AKC's Management Disciplinary Committee has suspended Jeffrey Scholten (Novi, MI) from all AKC registration privileges for a period of one (1) year, effective November 11, 2002, and imposed a $1000 fine for having submitted, or caused to be submitted, a litter registration application which he knew, or should have known, did not contain the personal signature of the owner of the sire. The AKC's Management Disciplinary Committee has suspended Maureen Schulz Tobias (Wauconda, IL) from all AKC registration privileges for a period of three (3) months, effective November 11, 2002, and imposed a $500 fine for for having submitted, or caused to be submitted, litter registration applications which she knew, or should have known, did not contain the personal signature of the owner of the dogs and no POA was on file. (Border Collie and Golden Retriever)

The AKC's Management Disciplinary Committee has suspended Connie Townsend (Bedford, IA) from all AKC privileges for a period of ten (10) years, effective November 11, 2002, and imposed a $2000 fine for failure to comply with the rules and regulations for recordkeeping and identification in that her dogs were not identified and failure to maintain her dogs in a manner acceptable to The American Kennel Club. The AKC's Management Disciplinary Committee has suspended Edwin Townsend (Bedford, IA) from all AKC privileges for a period of ten (10) years, effective November 11, 2002, and imposed a $2000 fine for failure to comply with the rules and regulations for recordkeeping and identification in that his dogs were not identified and failure to maintain his dogs in a manner acceptable to The American Kennel Club. (Multiple Breeds).

The AKC's Management Disciplinary Committee has suspended Lulu Mae Townsend (Bedford, IA) from all AKC privileges for a period of one (1) year, effective November 11, 2002, and imposed a $1000 fine for failure to maintain her dogs and facilities in a manner acceptable to The American Kennel Club. (Multiple Breeds)

The AKC's Management Disciplinary Committee has suspended Deborah K. Volkmar (Vaughn, MN) from all AKC privileges for a period of six (6) months, effective November 11, 2002, and imposed a $500 fine for having submitted, or caused to be submitted, two litter registration applications, which she knew, should have known, or had a duty to know, contained false certifications. (Multiple Breeds)

The AKC's Management Disciplinary Committee has suspended Sharon Weese (Rice, WA) from all AKC registration privileges for a period of three (3) months, effective November 11, 2002, and imposed a $500 fine for having submitted, or caused to be submitted, a litter registration application, which she had signed on behalf of the sire without having a properly completed. (Newfoundland)

Mr. Goodman gave the report of the Board Events and Clubs Committee.

It was moved by Mr. Goodman, seconded by Ms. Scully and VOTED (unanimously) to approve the Delegate credentials of the following persons, whose credentials have been published in two consecutive issues of the GAZETTE:

The Board reviewed the procedures for granting an extension for a dog to be entered in AKC events under an AKC litter or foreign registration number beyond thirty days. When a dog is first entered under a number other than an individual AKC registration number, a notice is sent to the owners, advising them of the thirty-day limit. There is also correspondence entailed in the granting of up to two extensions (60 days per extension for AKC litter number and 90 days for foreign registration numbers). Any titles earned while a dog is competing under a litter or foreign registration number would have to be pended until the dog is individually registered. All extensions must be input into the computer system. Following a motion by Mr. Goodman, seconded by Dr. Davies, it was VOTED (unanimously) to institute a $50 non-refundable processing fee for a 90-day event extension for all dogs, except those competing under a Foundation Stock Service number, effective January 1, 2003.

The Events and Clubs Committee also discussed the enforcement of judging contracts, and the policy restricting when employees of superintendents may exhibit.

Mr. Merriam gave the report for the Board Business Committee.

The Business Committee had previously agreed on the need to comply with the Ernst & Young recommendation that AKC establish an operating expense reserve balance of at least 50% of total operating expenses. Following a motion by Mr. Menaker, seconded by Ms. Scully, it was VOTED (unanimously) to establish an operating expense reserve of not less than 50% of the organization's total annual operating expenses.

The Business Committee also discussed a possible reduction in the supplemental transfer fee.

Dr. Battaglia gave the report for the Board Operations and Planning Committee.

Following a motion by Dr. Battaglia, seconded by Dr. Garvin, it was VOTED (unanimously) to add the Kennel Club of Pakistan to the list of registries with pedigrees acceptable for AKC registration.

The Board considered the registration of two English Foxhounds imported from England. The sire and dam of the litter are registered by the Masters of Foxhounds Association in England (MFA). However, dogs may not be individually registered until they have joined a pack and hunted. The puppies were imported during the ban on hunting during the Foot and Mouth epidemic. They have been registered by the International Foxhunters Stud Book, a domestic registry with pedigrees acceptable for AKC registration. Following a motion by Mrs. Schaefer, seconded by Mr. Goodman, it was VOTED (unanimously) to register the two dogs, based upon positive DNA identification.

Following a motion by Dr. Battaglia, seconded by Mr. Gladstone, it was VOTED (unanimously) to permanently retire the following kennel names, as requested by the indicated Parent Clubs:

"Abracadabra" at the request of the English Cocker Spaniel Club of America (registered in 1946 by Mrs. Arthur B. (Mary E.) DeGaris).

"Cleden" at the request of the Italian Greyhound Club of America (registered in 1944 by Louise and Philip Cleland).

"Dalquest" at the request of the Border Terrier Club of America (registered in 1945 by Margaret B. Harvey and Marjory L. Van Der Veer).

"Gayterry" at the request of the American Fox Terrier Club (registered in 1935 by Thomas and Katherine Gately).

"Hardway" at the request of the Dachshund Club of America (registered in 1941 by Jeanette Cross).

"Momarv" at the request of the Old English Sheepdog Club of America (registered in 1950 by Mona Berkowitz).

"Monadnock" at the request of the Siberian Husky Club of America (registered in 1932 by Lorna Demidoff).

"Sirrah Crest" at the request of the American Boxer Club (registered in 1940 by Rafael and Phoebe Harris).

The Operations and Planning Committee also discussed adding the Estonian Kennel Union, the Kennel Club of Thailand, and the Kennel Association of Sri Lanka to the list of registries with pedigrees acceptable for AKC registration. The committee also discussed policies and procedures concerning kennel names and the Judging Application procedure.

Mrs. Strand gave the report for the Board Public Affairs and Public Relations Committee.

The Board reviewed a proposed revision to the Dog Care and Training video, which was produced in 1993. Following a motion by Ms. Scully, seconded by Mr. Gladstone, it was VOTED (unanimously) to approve a budget of $71,100 to produce a new Dog Care and Training video.

The Public Relations and Public Affairs Committee also discussed 2003 Communication Plans.

Mrs. Strand exhibited samples of a streamlined logo, which still met the Bylaw description. Following a motion by Mr. Kelly, seconded by Ms. Scully, it was VOTED (unanimously) to approve the streamlined logo.

Meeting adjourned at 6:03 p.m., Monday, November 11, 2002.


Meeting reconvened Tuesday, November 12, 2002 at 8:00 a.m. All Directors were present. The Chief Operating Officer and Executive Secretary were also present.

The Board discussed the Parent Club Conference, recently held in Cincinnati. Those Board members, who attended, felt it was very productive and were very impressed with the enthusiasm shown by the attendees. All agreed that congratulations were in order for the members of the Parent Clubs Committee, who worked so hard to make this endeavor the success it clearly was.

Mr. Marden made a motion to take off the table his previous motion to lift the moratorium on NGA Greyhounds. The motion was seconded by Dr. Mays, but failed with the VOTE (affirmative, Dr. Mays, Dr. Davis, Mr. Goodman, Mr. Marden; opposed, Mr. Menaker, Mr. Merriam, Ms. Scully, Mrs. Strand, Mrs. Schaefer, Mr. Gladstone, Mr. Kelly, Dr. Garvin, Dr. Battaglia). Mr. Crowley reported that the Greyhound Club of America had been given until December 10, 2002 to submit a formal request to permanently eliminate the registration of dogs, based upon NGA pedigrees in accordance with the Board guidelines adopted in October 2002.

The Board discussed the DNA Advisory Committee report.

The Board reviewed a proposal, prepared by Dr. Battaglia to develop ways for the Board members to have access to more useful information to help them understand AKC's customers and business. It was suggested that a study be undertaken of what is done now, what statistical information is available and how it may be produced in a meaningful format. Mr. Menaker and Mr. Cheauré agreed to identify key indicators and to develop a framework for providing more beneficial information to the Board.

The Board examined the Dog Show Point Schedule, focusing on changes resulting from the recent divisional realignment. This will continue to be monitored.

There being no further business to come before the meeting, and upon motion made and seconded, it was VOTED: To adjourn at 12 Noon., Tuesday, November 12, 2002.
